5.2 Payment Methods

We accept payment through the methods specified on our website. By providing payment information, you represent and warrant that you are authorized to use the designated payment method.

5.3 Recurring Payments

For subscription-based Services, you authorize us to charge your payment method on a recurring basis. You may cancel your subscription at any time by following the instructions on our website or by contacting us directly.

5.4 Late Payments

If your payment is not received by the due date, we may suspend or terminate your access to the Services. We reserve the right to charge late fees on overdue amounts.

6. Intellectual Property Rights

6.1 Our Intellectual Property

The Services and all content, features, and functionality thereof, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, software, and the compilation thereof, are owned by Growth Mastery, its licensors, or other providers and are protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use. This license does not include:

8. Cancellation and Rescheduling

8.1 Coaching Sessions

Cancellation or rescheduling of coaching sessions must be made at least 24 hours in advance. Sessions cancelled within 24 hours of the scheduled time may be charged in full at our discretion.

8.2 Workshops and Events

Cancellation policies for workshops and events will be specified at the time of registration. Generally, cancellations made 7 or more days before the event may be eligible for a full refund, while cancellations made less than 7 days before may be eligible for partial refunds or credit toward future services.

9. Termination

We reserve the right to suspend or terminate your access to the Services at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.

Upon termination, your right to use the Services will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including without limitation ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICES OR THE SERVERS THAT MAKE THEM AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, GROWTH MASTERY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES;
• ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES;
• ANY CONTENT OBTAINED FROM THE SERVICES; OR
• UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING OR USING OUR SERVICES DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless Growth Mastery and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

• Your use of the Services;
• Your violation of these Terms;
• Your violation of any rights of another;
• Your conduct in connection with the Services.

13. Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Czech Republic, without regard to its conflict of law provisions.

13.2 Arbitration

Any dispute arising out of or relating to these Terms or the Services shall be finally settled by arbitration administered by the arbitration court in accordance with its rules. The arbitration shall take place in Most, Czech Republic, and shall be conducted in the English language. The decision of the arbitrator shall be final and binding, and judgment on the award rendered may be entered in any court having jurisdiction.

13.3 Class Action Waiver

YOU AGREE THAT ANY CLAIMS RELATING TO THESE TERMS OR THE SERVICES SHALL BE BROUGHT IN YOUR INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION OR REPRESENTATIVE PROCEEDING.

14. Miscellaneous

14.1 Entire Agreement

These Terms constitute the entire agreement between you and Growth Mastery regarding the use of the Services, superseding any prior agreements between you and Growth Mastery relating to your use of the Services.

14.2 No Waiver

The failure of Growth Mastery to exercise or enforce any right or provision of these Terms shall not operate as a waiver of such right or provision.

14.3 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

14.4 Assignment

You may not assign or transfer these Terms, by operation of law or otherwise, without the prior written consent of Growth Mastery. Any attempt to assign or transfer these Terms without such consent will be null and void. Growth Mastery may assign or transfer these Terms, at its sole discretion, without restriction.

14.5 Force Majeure

We shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including, but not limited to, acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, epidemics, pandemics, or shortages of transportation facilities, fuel, energy, labor, or materials.
